Bailiff: A Decree to Regulate the Organization of the Profession

The Government Council has adopted a draft decree establishing the procedures for organizing the bailiff profession, as part of the implementation of the reform introduced by Law 46.21.

The Government Council adopted, on Thursday, draft decree No. 2.25.885 implementing Law No. 46.21 relating to the organization of the bailiff profession, presented by the Minister of Justice.

This draft decree falls within the framework of implementing the provisions of Law No. 46.21 on the organization of the bailiff profession, promulgated by Dahir No. 1.25.49 of June 6, 2025, which introduced a comprehensive reform of the profession, with the aim of better regulating it and improving its performance, in order to strengthen its role in the service of justice and contribute to judicial efficiency, the Minister Delegate in charge of Relations with Parliament and Government Spokesperson, Mustapha Baitas, stated during a press briefing following the Council meeting.

This text thus implements the provisions of the aforementioned law, in particular by setting out the system and procedures for organizing the entrance examination to the bailiff profession, the end-of-training exam, and continuing education, Mr. Baitas explained, adding that the draft also establishes the modalities for determining fees and allowances, the criteria governing the bailiff’s travel, as well as the minimum threshold for civil liability insurance.

The text also includes provisions relating to the determination of membership fees, contributions, and travel allowances, as well as the establishment of a standard partnership contract between bailiffs, he noted, adding that it also defines the characteristics of professional attire, the professional card, and the badge, as well as the contexts in which such attire must be worn.
