Copyright: The Government Council Adopts a Draft Decree on Reproduction Royalties

The Government Council approved, on Thursday, the draft decree relating to copyright and related rights, with regard to the proceeds from reprographic reproduction, presented by the Minister of Youth, Culture and Communication, Mohamed Mehdi Bensaid.

This concerns Draft Decree No. 2.25.550, which supplements and amends Decree No. 2.23.76 of 15 Moharam 1445 (2 August 2023), implementing Law No. 2.00 relating to copyright and related rights with respect to the proceeds from reprographic reproduction.

This project aims to adapt the regulatory framework governing reprographic reproduction rights to the requirements of economic realities and to respond to the evolutions of the market for reproduction and printing devices, both as regards the nature and technical characteristics of the equipment and the volume of investments related to their acquisition, as stated by the Minister Delegate in charge of Relations with Parliament, Government Spokesperson, Mustapha Baitas, at a press conference following the Council.

This decree project, he noted, aims to modify Article 3 of Decree No. 2.23.76, by revising the current system based on a unified rate of reprographic reproduction proceeds, fixed at 10% of the production cost of these devices if manufactured locally, or their purchase price excluding tax if imported, through the adoption of a new system based on the principle of proportionality of the flat-rate price to the production cost or to the import price of devices subject to reprographic reproduction proceeds, using a sliding scale of rates that takes into account the principle of fairness and justice.
